News Updates...ACAL News – Week of 2 February 2007The Ava Landfill Story has reached all the way to Chicago, Illinois … thanks to the time and talented efforts of journalist Roger Kamholz and Northwestern University’s Medill News Service, “On the Docket.” On December 27, 2006 “One man’s trash is another man’s landfill” was published on Medill News’s website. It is a story worth reading, http://docket.medill.northwestern.edu/archives/004216.php. For those who may not have Internet access, the following is the opening paragraph and brief summary of the article with some added details. “Garbage trucks began arriving at the newly constructed 1,039-acre Ava landfill, located in central New York State, on October 24, 2006 amid vehement objections from members of the Ava town government and the Adirondack Communities Advisory League (ACAL), a local environmental group.” Oneida-Herkimer Solid Waste Authority (OHSWA) executive director Hans Arnold was quoted in the December 3, 2006 Observer-Dispatch calling the landfill “a true regional asset.” Regarding the alleged Clean Water Act violations, DEC spokesman Stephen Litwhiler stated, “the streams near the landfill had experienced siltation”, while Hans Arnold said “the stream had been discolored.” ACAL’s lawsuit states that “on at least 27 occasions sediment, silt and pollutants flowed [from the landfill] into the South Branch of Moose Creek.” Kamholz wrote an original article for “On the Docket” regarding United Haulers’ lawsuit against OHSWA last September. Oral arguments for this suit were given in Supreme Court early last month. The Court will rule as to whether Oneida and Herkimer county laws, that support OHSWA and flow control, are constitutional. Responding to the United Haulers lawsuit, Hans Arnold said, “It won’t present even a bump in the road for us here, because we have all the waste tied up contractually.” This means that over the past several years, OHSWA has been soliciting Oneida and Herkimer County townships and creating contractual garbage agreements, securing plenty of garbage for OHSWA’s landfill located in the Town of Ava; a town, which produces less than 1% of the garbage generated in the two-county region. Ava Town Supervisor Dave Mathis told Kamholz the Authority has “never, ever, ever made us a firm offer of anything.” Hans Arnold states, “he made at least 13 offers to Ava concerning a benefits package.” What Arnold has neglected to share, to my knowledge there has never been a formal offer submitted to Ava such as the one OHSWA recently created for the town and village of Boonville. Roger Kamoltz is to be applauded for taking an interest in the Ava landfill story, an example of what is happening to small rural communities throughout the United States. Add to these efforts, the ongoing diligence of ACAL, and the adamant refusal from Ava government to accept one penny for a landfill that was forced into their community. As long as the Town of Ava refuses to accept anything from the Authority, it retains the power to defend its citizens against future pollution, accidents, and health problems. It is ACAL’s hope that the town and village of Boonville will follow Ava’s lead and refuse to sign away the right to protect its citizens from anything associated with the landfill. Boonville residents are encouraged to contact Mayor Ernst and Supervisor Case and express your concerns regarding future action of the boards with OHSWA. Citizens’ rights are never for sale – NEVER. And the Ava landfill story has a right to be told … even in Chicago!
