News Updates...ACAL News – Week of 26 January 2007The article entitled “Corporations face growing backlash as towns assert rights” located in the Winter 2006 issue of Sierra Atlantic Newsletter, directly relates to issues concerning the siting, construction, and alleged Clean Water Act violations of the Oneida-Herkimer Solid Waste Authority’s (OHSWA) landfill located in the Town of Ava. The article, written by Sierra Club member Yvonne Tasker-Rothenberg, discusses the rise in corporate power and the increase of corporate influence in the court system, and how local townships need to reclaim their rights. The article explains that a common goal of Sierra Club activists is “to force our government to better respond to the needs of our citizens and, most importantly, to respect the laws of nature. To do this we must educate ourselves about how we came to be dominated by corporate capitalism and how we can change this paradigm and reclaim our democracy before it is too late.” According to the State Water Quality Fact Sheets from the Clean Water Network, www.cwn.org, New York State ranks 3rd in the nation for number of major facilities in significant non-compliance. There is a serious problem with New York’s regulatory agency (Department of Environmental Conservation) when nearly 50% of its major and industrial facilities combined are in significant non-compliance. The Sierra Club’s Corporate Accountability Committee asks an important question regarding corporate power: “Who did this and why?” If a town such as Ava doesn’t want a landfill in its community, why should a corporation (OHSWA, a public authority) and a state regulatory agency (DEC) be able to force a landfill into the town? Who gave OHSWA and the DEC the power to strip Ava of the right to protect its citizens? Throughout New York State, small towns are fighting to keep obsolete, polluting landfills out of their communities through “home rule”, the general powers of local governments to adopt and amend local laws. Many of these townships, such as the Town of Albion, have been successful in exercising their citizens’ rights by keeping landfills out. The Town of Ava is a unique case. Ava has no rights because their power has been taken away and given to the DEC and OHSWA. Ms. Tasker-Rothenberg concluded her article with this summary: "We should spend less time fighting regulatory agencies on specific issues and more time enacting laws that redefine the role of regulatory agencies so that they protect human beings and the planet instead of corporations." ACAL couldn’t agree more. That is why ACAL has exercised its citizens’ rights by filing a lawsuit against OHSWA for allegedly violating the Clean Water Act. Corporations and public authorities must be held accountable for polluting the land, air and waters in the state. It is the right and responsibility of New Yorkers to reclaim their powers by insisting that environmental laws apply to everyone. In addition, the DEC must fulfill its duty to the citizens of New York by following its own laws and regulations, and refuse to give corporations and public authorities permission to pollute the environment.
