News Updates...ACAL News – Week of 12 January 2007In 1987, Oneida and Herkimer Counties initiated a landfill effort. One year later, the counties supported the creation of the Oneida-Herkimer Solid Waste Authority (OHSWA), which was approved by Governor Mario Cuomo. In addition to his signature, the Governor gave OHSWA $50 million in bonds for “start-up costs.” Fifty million dollars is the equivalent of a $30,000 annual income for one person for 1,667 years. What started with county government in 1987 may end with local government in 2007. The siting, construction, and aftermath of OHSWA’s landfill is not only a big, ugly black eye for Oneida County – the highest taxed county in the State – but the Town and Village of Boonville may be getting ready to shoot themselves in the proverbial foot. It is a proven fact that landfills, prisons, mines, and other “undesirable” facilities almost always make their way into rural communities across America. Corporate and government sponsors of such facilities know full well the negative impacts they are placing on the shoulders of the rural towns and villages that agree to accept these places into their communities. So to offset the action of bringing potential harmful facilities into rural areas, developers offer “local or host community benefit packages.” These so-called “benefit packages” usually constitute some form of monetary amount because rural towns and villages always need money. Unless they are innovative and apply regularly for state and federal grants, rural municipalities constantly struggle to meet their budgets. This financial need makes rural areas the prime target for "undesirable" facilities and always will be, unless small towns and villages fight back like the Town of Ava. The Town of Ava has never agreed to accept OHSWA’s landfill into their town. No offer of financial support has been offered to Ava from the Authority in the ten years it took OHSWA to construct its so-called state-of-the-art landfill. What is most upsetting, is that New York State Public Authorities supercede town laws making Ava, and every other town in the entire State, vulnerable to injustice, disrespect and violation of citizens’ rights. If towns cannot protect themselves and its citizens from potentially harmful facilities FORCED into their communities by public authorities, then there is a serious problem with New York State laws. The Town and Village of Boonville were presented with a “local community benefits package” by OHSWA at a public hearing on Thursday, January 11, 2007. Of the twenty-four items listed on the “proposal” for Boonville, only one is worth addressing: The village and town agree that the village and town will not participate directly or indirectly in name or by action or by any monetary support in any legal challenges to the operation of the landfill facility. Should the Boonville boards decide to accept the “local community benefits package” from OHSWA, they will forfeiting the rights of all town and village citizens to protect themselves from potential health, safety and environmental dangers that could harm them, their children, and future generations for the duration of the landfill or a minimum of 62 years! Garbage truck accidents, leachate and garbage spills, polluted water, stench and seagulls, increased rate of cancer - anything that could be connected with the landfill will be hands off for the Town and Village of Boonville should they sign on with OHSWA. I ask the citizens of Boonville: Are you willing to sacrifice your rights to protect yourself and your family? If not, then insist the boards DO NOT sign the agreement with OHSWA. “Local community benefits” that contain statements like the one created by OHSWA are appallingly unjust when rural citizens must sacrifice their rights in order to receive something in return. Citizens' rights are not for sale! If OHSWA really wants to offer the towns something, let them do so, free and clear, with absolutely no strings attached. If they refuse, then their “local community benefits package” isn’t worth the paper it is written on!
