Further, the plan calls for a reduction in packaging by manufacturers and a reduction in climate and environmental impacts caused by transporting waste and harmful emissions coming from incinerators and landfills.

The town board and the citizens they represent are genuinely concerned about the environment in Ava. They are extremely distressed that OHSWA and Rifenburg have been given permission by the DEC to allow excessive sediment to enter Moose Creek - "a provision that is contrary to the basic mission of the DEC."

News Updates...ACAL STATEMENT
All environmental permits held by the Oneida-Herkimer Solid Waste Authority prohibit excessive sediment from entering Moose Creek. The General State Pollutant Elimination System (SPDES) permit is the enforcer of the Clean Water Act. The Authority has been discharging sediment into Moose Creek since major landfill construction began in the spring of 2005.
As a result of these discharges, the DEC issued the Waste Authority a Notice of Violation on Sept. 2, 2005. However, contrary to enforcing state environmental laws, 5 months later, the DEC issued an unprecedented Consent Order giving the Waste Authority permission to continue polluting Moose Creek.
The Waste Authority is presently the defendant in a citizens’ lawsuit filed by ACAL in June 2006 for allowing ongoing discharges from the Ava Landfill site to enter the trout spawning stream of Moose Creek and for allegedly violating the federal Clean Water Act.
OHSWA must be stopped from further polluting Moose Creek. The most recent occurrence was documented on October 17. They continue to ignore state and federal environmental laws, with no accountability or concern for the people of this area.
The Waste Authority is not above the law. A New York State Public Authority must abide by the same laws as all New York State citizens, but unfortunately, no government agency, including the DEC, Governor and Attorney General’s Office are enforcing the law.
OHSWA is one example of a New York State Public Authority out-of-control. Opening this landfill a few weeks before the election is a strong indication that it was politically fueled. As a result, citizens’ rights are not only being violated by state officials, the freedom to live as we see fit is being threatened.
Many people have asked ACAL about filing an injunction and we have discussed this at length with our attorney. Although I am not at liberty to speak of actions pertaining to our lawsuit, ACAL does not have unlimited funds like the Waste Authority who is funded by the State. As a result, ACAL must make difficult decisions, sometimes on a daily basis, regarding appropriate actions. Holding State agencies accountable is very expensive. ACAL will continue to seek necessary funding so we can hold these agencies responsible for failing to comply with state and federal environmental laws.
ACAL’s future actions include monitoring Moose Creek and gathering documentation for our citizens’ lawsuit against the Waste Authority. We will continue to get the word out to other parts of the State and country concerning the disgrace and injustice of siting a landfill adjacent to a Veterans’ Memorial Forest and literally forcing it into the Town of Ava.
ACAL is not the only small, grass-roots organization in the state working to preserve and protect its community from injustice and pollution. It is the small, persistent groups like ACAL that expose politically fueled projects like the Ava Landfill, and seek the necessary assistance to right a wrong.
The Ava Landfill is wrong. It should have never been sited in one of the wettest areas in New York State and bordering a tributary of the Black River, which supplies the City of Watertown and Fort Drum with its drinking water. But the state wanted a landfill and they forced it into the poor, small rural town of Ava, despite the town’s adamant opposition.
The people of Northern Oneida and Southern Lewis counties need to know the truth. And the truth is coming from 13 years of research, action and legal representation through ACAL … not from Hans Arnold, not from OHSWA, not from the Utica and Rome newspapers, and not from the DEC.
People in the area must not ignore what has happened and continues to happen to this community. State agencies and politicians are NOT always right and their actions are NOT always in the best interests of the people. The State has condoned the siting and construction of the Ava Landfill, and is allowing OHSWA free-reign over a 1,039-acre landfill site. This type of political bamboozling must be stopped.
How? By supporting ACAL. ACAL’s mission is to preserve and protect the environment in our community, and that’s exactly what we intend to keep doing.
