The town board and the citizens they represent are genuinely concerned about the environment in Ava. They are extremely distressed that OHSWA and Rifenburg have been given permission by the DEC to allow excessive sediment to enter Moose Creek - "a provision that is contrary to the basic mission of the DEC."

News Updates...ACAL News – Week of 20 October 2006
On August 11, 2006, Regional Water Engineer for the New York State Department of Environmental Conservation (DEC) Region 6 Steven Botsford wrote to Oneida-Herkimer Solid Waste Authority (OHSWA) Executive Director Hans Arnold regarding water quality standards and Don Lake’s May 11, 2006 stormwater inspection at the Ava landfill site.
Engineering Specialist for the New York State Soil and Water Conservation Committee Don Lake, performed an independent technical evaluation of the stormwater pollution prevention system at the landfill site. According to the DEC August 11 letter, Mr. Lake’s stormwater control recommendations further increase the compliance as required by the DEC’s Consent Order issued to the Waste Authority on February 13, 2006.
“ …The test will address whether the computer model’s prediction that the SSCS can remove 99.94% of the sediment from on-site stormwater is correct, and if so, whether the resulting 0.06% will cause a significant visible contrast and future water quality violations. These questions need to be answered and the results submitted as part of an individual application for a permit to discharge stormwater, both during the operation of the landfill and during the construction of new cells.”
As a result of the ongoing discharge of sediment into Moose Creek, the Oneida-Herkimer Solid Waste Authority (OHSWA) will be required to apply for an individual State Pollutant Discharge Elimination System (SPDES) permit through the DEC.
So what does this mean for the Ava Landfill?
According to the August 11 DEC letter, OHSWA cannot accept garbage at the Ava Landfill until 3 things are present:
1. OHSWA’s stormwater management system must stop discharging sediment into Moose Creek.
2. Once the sediment has stopped discharging into Moose Creek, OHSWA must then pass the required DEC tests, ensuring they are complying with water quality standards.
3. OHSWA must apply for and be granted an individual SPDES permit from the DEC.
OHSWA has been unable to stop sediment from entering Moose Creek; the most recent incident occurring just a few days ago on October 17, 2006. Secondly, since sediment continues to be discharged into Moose Creek, ACAL has no indication that any tests have been performed on the landfill site as required by the August 11 DEC letter. And finally, according to the DEC’s website and other sources, OHSWA has not applied for the individual SPDES permit or for its landfill operational permit, both of which are required to be posted for public notice.
Therefore, despite the fact that Hans Arnold and OHSWA have indicated to Utica and Rome press and other media sources, they plan to open the landfill with a few weeks, based on the strict requirements outlined by the August 11 DEC letter, in addition to state and federal environmental laws, OHSWA is not ready to accept garbage at the Ava Landfill.
However, since OHSWA has a long history of disregarding environmental law and regulations, ACAL has alerted the State to the ongoing problems with OHSWA and the Ava Landfill site, and is utilizing every available resource to ensure that regulations are being followed.
