| 06/21/10 | NYSDEC New Solid Waste Plan Draft | Entitled Beyond Solid Waste - A Sustainable Materials Management Strategy for New York, the NYSDEC has drafted a 480-page plan to reduce solid waste through increases in reuse, recycling and composting in local communities. Further, the plan calls for a reduction in packaging by manufacturers and a reduction in climate and environmental impacts caused by transporting waste and harmful emissions coming from incinerators and landfills.

| 03/20/06 | Ava Complaint to DEC | The Town of Ava sends a letter to Region 6 DEC requesting their Consent Order be rescinded. The town board and the citizens they represent are genuinely concerned about the environment in Ava. They are extremely distressed that OHSWA and Rifenburg have been given permission by the DEC to allow excessive sediment to enter Moose Creek - "a provision that is contrary to the basic mission of the DEC."

News Updates...ACAL News – Week of May 5, 2006
“Landfill Protesters Fight Final Battle” reads an October, 2000 article in Waste Age Magazine. The story, written by then assistant editor, Brook Rafio, goes on to describe how residents and war veterans from Ava, NY “are protesting the landfill because they are concerned about the possible environmental effects. They also say the landfill will dishonor the memories of war veterans.”
Oneida-Herkimer Solid Waste Authority (OHSWA) Engineer Mike Wolak told Waste Age “the [landfill] site’s proximity to the Veterans’ Memorial Forest never influenced the Authority’s decision … one of the original sites considered actually overlapped the forest.”
Steve Litwhiler, “citizen participation specialist” for Region 6 DEC stated, “Things do not look good for the opposition. We have issued a draft permit because everything we see says that a landfill can be constructed [on the site] and would be environmentally sound.”
Based on the opinions of OHSWA’s engineer and DEC’s “citizen participation specialist”, the assistant editor of Waste Age assumed the “landfill protestors” were fighting their final battle.
Five and a half years later, I am delighted to say that there has never been a final battle against OHSWA and the construction of the Ava Landfill. And there never will be.
The mission of Adirondack Communities Advisory League (ACAL) is to preserve and protect the environment in the Northern Oneida, Southern Lewis County region of the Tug Hill Plateau. ACAL is not comprised of merely “landfill protesters”, “objectors”, and “opponents”. ACAL consists of dedicated, community-minded individuals who respect the precious resources that have sustained our simple and peaceful way of life for generations. As long as the environment in our community is being threatened, ACAL will stand strong against polluters and insist that justice be served.
Whenever I think of the stench and visual assault of garbage blowing into the Veterans’ Memorial Forest, I want to cry. How could OHSWA totally disregard the sacredness of a Memorial dedicated to American veterans? How could they select this Memorial as their first choice for a landfill? How could Senator Ray Meier, who was then Oneida County Executive, try to manipulate and change County Law 219 so OHSWA could build their landfill in the Memorial Forest? OHSWA and Senator Meier should be ashamed of themselves for allowing this travesty to go so far.
Over the years, OHSWA’s stock answer regarding the landfill’s shared border with the Veterans’ Memorial Forest is the so-called “buffer” that lies between them. Anyone who lives on “the hill”, knows about the irregular patterns of wind – sometimes swirling round and round. No “buffer” area or “litter fence” will ever keep garbage out of the Memorial Forest. Since when does a landfill take precedence over American veterans?
And Mr. Litwhiler’s comment, “We have issued a draft permit because everything we see says that a landfill can be constructed [on the site] and would be environmentally sound.”
Environmentally sound? Does the DEC consider repeated violations of OHSWA’s DEC and Army Corps’ permits “environmentally sound”? Excessive runoff and sediment entering Moose Creek from the landfill site is “environmentally sound”? OHSWA polluting the trout spawning stream of Moose Creek, a federally protected waterway of the United States under the Clean Water Act, is considered “environmentally sound”?
The DEC is guilty of violating environmental law. The February 2006 Consent Order is not only illegal, but it gives OHSWA and Rifenburg permission to pollute Moose Creek. If this is the DEC’s definition of “environmentally sound”, then New Yorkers are in really big trouble.
The time has come for OHSWA and the DEC to be held accountable for their actions. OHSWA can no longer hide behind the skirts of the DEC. Failure to comply with environmental law is a serious offense. If private citizens are expected to follow the law and protect the environment, then OHSWA and the DEC must comply as well. State entities are not immune to federal laws created to protect our precious resources.
ACAL will continue to pursue justice for the good people of this community until justice is served. It is our civic duty and responsibility. It is our mission.
