06/21/10	NYSDEC New Solid Waste Plan Draft	Entitled Beyond Solid Waste - A Sustainable Materials Management Strategy for New York, the NYSDEC has drafted a 480-page plan to reduce solid waste through increases in reuse, recycling and composting in local communities. Further, the plan calls for a reduction in packaging by manufacturers and a reduction in climate and environmental impacts caused by transporting waste and harmful emissions coming from incinerators and landfills.
06/17/10	New Yorkers for Zero Waste Platform 2010	Local, regional, state and federal organizations join with NY Zero Waste Alliance, a project of Citizens Environmental Coalition, to support the reduction of waste through increase in reuse, recycling and composting.
10/24/06	11 August 2006 DEC Letter	Region 6 Water Engineer Steven Botsford's letter to OHSWA Executive Director Hans Arnold stating OHSWA's environmental responsibility for clean water quality compliance associated with the Ava Landfill site.
06/08/06	ACAL vs. OHSWA	ACAL filed a lawsuit against OHSWA for polluting the trout spawing stream of Moose Creek for over a year. The ongoing pollution to the creek violates State environmental law and the Clean Water Act.
04/20/06	Letter to Ava from OHSWA	Lengthy letter from OHSWA Executive Director Hans Arnold to the Ava Town Board regarding a "host community benefit package". The Ava board refuses to negotiate with OHSWA for a 1000+/- acre landfill that is being forced into their rural community.
03/31/06	DEC response to Ava	DEC Region 6 Director Sandra LeBarron's letter to Town of Ava regarding Ava's request to rescind the March 2006 DEC Consent Order and take "appropriate enforcement action". Ms. LeBarron states the DEC's response must be "somewhat restrained" since ACAL has filed a notice of intent to file a citizen's suit against OHSWA.
03/21/06	Notice of Intent to Sue	Pursuant to the Clean Water Act, against the Oneida-Herkimer Solid Waste Management Authority (OHSWA) and Rifenberg Construction, Inc. by Adirondack Communtities Advisory League (ACAL)
03/20/06	Ava Complaint to DEC	The Town of Ava sends a letter to Region 6 DEC requesting their Consent Order be rescinded. The town board and the citizens they represent are genuinely concerned about the environment in Ava. They are extremely distressed that OHSWA and Rifenburg have been given permission by the DEC to allow excessive sediment to enter Moose Creek - "a provision that is contrary to the basic mission of the DEC."
02/13/06	NYSDEC Consent Order	NYSDEC is giving OHSWA permission to discharge excessive sediment and water into nearby Moose Creek, a federally protected trout spawning stream in Ava, NY.

NYS Waste Disposal Policies Not Followed

Seventeen years after the passage of the Solid Waste Management Act of 1988, and the enactment of a state solid waste management policy designed to protect and preserve New York’s natural resources, New York State Department of Environmental Conservation (NYSDEC) has done little to advance environmental protection in solid waste disposal.

According to the Draft New York State Solid Waste Management Plan, 2001-2002, with waste reduction being the cornerstone of this plan, 17.2 million tons of waste was recycled in 1999, compared to 4.3 million tons recycled in 1990. Despite this improvement, data also shows that in that same time period, solid waste generated in the state has increased 46%. NYSDEC has approved massive amounts of landfill disposal capacity. At the time of this report, NYSDEC was reviewing applications for new landfill disposal capacity totaling 92.7 million tons.

According to New York State Environmental Conservation Law of 1988, waste-to-energy is clearly the preferred environmental method for solid waste disposal over landfill technology. This is also reflected in the Draft NYS Solid Waste Management Plan, 2001-2002. However, the report shows that from 1990-2000, the amount of solid waste disposed of by waste-to-energy remained fairly constant, increasing only slightly from 3.4 million tons to 3.6 million tons in 2000.

Waste-to-energy technology reduces the volume of waste for disposal by 90%. Federal Emission Guidelines mandate stringent controls, making these facilities much safer for the environment. There are only 10 operating waste-to-energy facilities compared to 27 municipal solid waste landfills, according to the 2001-2002 report. In 2000, 3.6 million tons of waste went to waste-to-energy compared to 9.3 million tons to landfills. New York State does not promote, nor follow their solid waste disposal policies that are intended to protect our environment.

When will the NYSDEC take action to enforce state policies designed to protect the natural resources and abundant wildlife habitat in the beautiful state of New York? Serious environmental protection will not happen until rural, low population, lower income areas throughout the state become overrun with polluting landfills. Only then will New York State decide that landfills are too dangerous for the environment. Only then will politicians decide they have a responsibility to promote safe means of waste disposal for ALL citizens.

Economically depressed rural areas are targets for landfill development. Powerful government agencies and huge private companies such as Waste Management, look to these areas thinking they can pressure communities into accepting money in exchange for hosting harmful megalandfills. Aside from the Adirondack Park, where landfills are banned, the pristine Tug Hill region of New York is the last frontier for landfill developers. This, combined with the fact that New York City intends to use upstate New York as their dumping ground, should send a red flag to every rural citizen in the Tug Hill region. It’s no coincidence that Waste Management is now advertising on our local television stations. If we are to protect this beautiful area for future generations, we must all pay attention to what is happening around the state.
