Local residents continue to notice increased turbidity in the waters of Moose Creek, a trout stream adjacent to the Ava landfill construction site. New York State Department of Environmental Conservation (NYSDEC) Engineer Gary McCullouch previously stated that a visible increase in turbidity is a violation of Oneida-Herkimer Solid Waste Authority’s (OHSWA) landfill construction permit.
While area residents wait to hear the results of NYSDEC’s investigation into repeated permit violations, OHSWA has stepped up the pace of construction at the site. Local residents note construction crews have been working well into the night, causing an increase in noise disturbance. OHSWA reports construction is on schedule and progressing well. Residents wonder why the long work hours are necessary.
As reported in the Boonville Herald and on our local radio station, Boonville Village Trustee Phyllis White shared landfill facts with the public following a recent two hour tour of the Ava landfill construction site. Decisions that are made today by elected local officials will affect the communities for the next century. It is disappointing to think a local official would draw conclusions and report to the public after consulting only the Waste Authority.
Several points should be considered when evaluating Ms. White’s statements. There is no guarantee the current law prohibiting waste importation won’t ever be changed in the future. OHSWA has refused to stipulate a non-transferable permit.
When OHSWA moved the landfill footprint east of the Veterans’ Forest, they located the landfill in an area marked unfavorable hydrogeology on their 1993 map. NYSDEC granted OHSWA a waiver to Part 360-2.13(d) regulation that requires a minimum separation of five feet between the liner system and the seasonable high groundwater table. A groundwater suppression system must be maintained for the life of the landfill.
We will never know the full characterization of the aquifer that lies beneath the landfill because NYSDEC failed to require definitive testing, as recommended by hydrogeologist Dr. Andrew Michalski. Michalski put his reputation on the line in his belief that references to the aquifer as “confined” were in error.
Ms. White indicates the Waste Authority is willing to modify truck traffic during peak bus transportation hours. Does that mean they are unwilling to modify the schedule if we don’t sign the host community agreement? Safety measures should not be tied to a host community agreement. In Pennsylvania, permits have been denied based on traffic routes that take trucks through small communities such as Boonville.
OHSWA appears to be using the bypass road as bait for Boonville. OHSWA will benefit most from any bypass road. One main route to the landfill sends trucks through Lyons Falls and Constableville, tacking on an additional 38 miles round trip. The bypass road was considered many years ago, long before it was considered part of any possible compensation package.
