| 03/20/06 | Ava Complaint to DEC | The Town of Ava sends a letter to Region 6 DEC requesting their Consent Order be rescinded. The town board and the citizens they represent are genuinely concerned about the environment in Ava. They are extremely distressed that OHSWA and Rifenburg have been given permission by the DEC to allow excessive sediment to enter Moose Creek - "a provision that is contrary to the basic mission of the DEC."

News Updates...On Friday morning, May 20, Ava and Boonville residents living within a 2-3 mile radius of the proposed landfill, were awaken at 5:30 AM by the sound of dynamite exploding. According to a local source, it appears the construction crew or another company working for the Oneida-Herkimer Solid Waste Authority is finding it necessary to discharge dynamite on the landfill site. A site, according to the Solid Waste Authority and DEC, was the best one out of 79 in Oneida and Herkimer counties to construct a landfill.
My question is, if the site is so perfect then why use dynamite?
If you ask any resident in this area, they will tell you the same thing: shale. Anyone who has built a home or anything on “the hill” knows that if you dig down past 6 feet, there is nothing but shale. Shale and water – lots of water – in the form of an aquifer, natural streams, and state and federal wetlands.
Local sources also report that Solid Waste Authority construction crews are loading huge dump trucks full of shale and taking it to unknown locations. Do they really think that moving around tons of shale – sharp, jagged shale – is going to allow them to build a garbage cell with a so-called state-of the-art liner? A liner that, Hans Arnold swears, will never leak. In your dreams, Hans! If you want your state-of the-art archaic landfill to work, you better pack up, get out, and try again somewhere else. I have a feeling that the land surrounding the Veterans’ Memorial Forest may not let you build your garbage dump. Now wouldn’t that be an awesome thing!!
Area residents continue to be sickened by the actions of the New York State Department of Environmental Conservation. How could the DEC, a state entity created to protect the land, waters and wildlife in New York State, allow such a potentially devastating environmental hazard to occur in this pristine area of the Tug Hill Region? I have no idea. But I can guess: politics, politics and more politics.
And I have another question to ask: If the Tug Hill Commission was created to protect the land, water, air and wildlife in the Tug Hill Region, which includes the towns of Ava, Boonville and Lewis, then why have they done absolutely nothing to help those communities protect their lands from a 700-acre landfill?
If the Ava landfill is built and actually opens, it will be the Tug Hill Region’s second landfill. (Rodman was the first.) If rural land, water and wildlife is so important to preserve, then why is the Tug Hill Commission allowing a second landfill to be constructed in this rural region of New York State?
A spokesperson for the Commission stated that they have not taken a side on the landfill(s) issue. When asked why, I was told to speak to the Commission board. Perhaps areas residents need to contact the Tug Hill Commission and ask them for an answer as to why they have not helped the people in this area stop the Ava landfill. I find it difficult to believe that an organization that should be protecting the environment is not complying with their mission statement.
I continue to be totally befuddled by the actions of New York State politics, authorities, organizations and individuals who continue to sit in their offices and turn their heads the other way, while acres of precious resources continue to be destroyed in rural upstate New York. Wouldn’t you think these so-called educated individuals would realize that once New York State’s land, water and air is polluted, residents will have no where to go but to leave the state? Is that the plan Governor Pataki? To turn New York into one big landfill? I’m beginning to wonder.
